For ensuring proper utilization of foreign funds, Foreign Contribution Regulation Act (FCRA) governs and regulates the receipt of any foreign contributions or grants within India. It has been made mandatory for all NGOs to obtain FCRA registration from government if they wish to acquire or receive any foreign contribution or grants.
Types of FCRA RegistrationTwo ways in which an organization can obtain registration are:
- Normal Registration
- Prior permission Registration
Basic Requirements for FCRA License
- For Normal Registration: The applicant must
- Be registered as NPO under appropriate law authorities
- Have spent a minimum of Rs. 10 Lakhs in previous three years for the attainment of its main objects for which the entity was registered excluding administrative expenses made.
- Possess last three years financial statement audited by a qualified chartered accountant shall be submitted by an applicant.
- For Prior Permission Registration: The applicant must
- Be newly registered as NPO under appropriate law authorities
- Submit a specific commitment letter from the donor to the Ministry of Home Affairs
- Give the details relating to a foreign owner who is contributing the fund
- Utilize funds for the specified purpose only
Pre-requisite Documents for FCRA License:
- Self-certified copy of document evidencing creation or registration of NGO like Memorandum of Association or Trust Deed
- Self-certified copy of instrument registration of NGO like Registration Certificate or Incorporation Certificate
- Copy of certificate obtained under section 80G and 12A of Income Tax
- Certified true copy of resolution passed by governing body of NGO
- Copy of PAN card of NGO
- Signature of chief judiciary in JPG format
- Details of Executive Committee
- Detailed report on activities of the preceding three years.
- Audited copy of financial statements of the preceding three years
